ARBITRATION NOTICE
UNLESS YOU OPT OUT OF ARBITRATION IN A TIMELY MANNER, AS OUTLINED IN THESE TERMS AND CONDITIONS, YOU AGREE THAT DISPUTES BETWEEN YOU AND US OR YOU AND THE MEDICAL GROUPS OR PROVIDERS ARISING OUT OF OR RELATED TO THESE TERMS AND CONDITIONS OR YOUR USE OF THE SERVICE WILL BE RESOLVED THROUGH BINDING, INDIVIDUAL ARBITRATION. BY DOING SO, YOU WAIVE YOUR RIGHTS TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION, AS DETAILED BELOW. ADDITIONALLY, EXCEPTIONS AND THE PROCEDURE FOR OPTING OUT OF ARBITRATION ARE OUTLINED BELOW.
Peak Revival Plus and the Service
Peak Revival Plus LLC and/or its affiliates (collectively, “Peak Revival Plus,” “we,” or “us”) own and operate the website we make available to you (the “Website”). Your access to and use of the Website, any part of it, or anything related to it, including its content (“Content”), any products or services provided through the Website or otherwise by Peak Revival Plus, and any affiliated websites, software, or applications owned or operated by Peak Revival Plus (collectively, including the Website and the Content, the “Service”) are subject to these Terms and Conditions (“Terms” or “Agreement”).
Please read these Terms carefully as they contain important terms and information you need to know about the Service. In these Terms, “you” and “yours” refer to the person using the Service. If the user is a minor between the ages of 13 and 18 (or a higher age of majority under applicable state law), “you” and “yours” refer to (i) the minor for whom consent is being provided or on whose behalf the Service is being used and (ii) the parent or guardian providing consent for the minor to use the Service. For details on minors and restrictions, see “Limited Use and Availability.” The Service is not intended for individuals under thirteen (13); those under 13 are prohibited from using any part of the Service or entering into this Agreement even
if a parent or legal guardian is willing to provide consent to use of the Service or this Agreement.

Acceptance of Terms and Conditions
Your access to and use of the Service is governed by this Agreement and all applicable laws and regulations. If you do not accept and agree to this Agreement in its entirety, you are prohibited from visiting, accessing, registering with, or using the Service or any Content, except to review this Agreement. The Service may change over time; we may modify or remove any part of this Agreement or the Service at our sole discretion, without prior notice. Changes become effective when posted on the Website. Unless stated otherwise, any new Content added to the Service is subject to this Agreement once posted. If you do not agree with any changes, your only recourse is to stop using the Service. Your continued use after any changes to this Agreement are posted constitutes your acceptance of the modified terms.
Your Relationship with Us
We offer certain products and services to individuals who register as users of the Service (“Users”), which may be sold or provided by Peak Revival Plus, independent medical providers and medical groups, pharmacies, or other vendors. The Service may provide access to prescription fulfillment services through one or more licensed pharmacies with which we have relationships (collectively, the “Pharmacies”). By using the Service, you agree your prescription(s) may be filled and transferred among the Pharmacies and authorize the Service to facilitate this on your behalf.
We may also provide access to an independent medical group (the “Medical Group”) for the provision of healthcare and/or mental health services through the Website. The Medical Group employs or contracts with physicians, allied health professionals, and/or mental health professionals who provide certain services through the Website (the “Providers”). By accepting this Agreement, you acknowledge that any services you receive from the Pharmacies, the Medical Group, or the Providers through the Website are also governed by this Agreement, and those entities are third-party beneficiaries of this Agreement.
We do not control or intervene in the practice of medicine or healthcare by the Medical Group or any Provider; each is solely responsible for directing the care or treatment they provide. Peak Revival Plus does not control or interfere with professional services provided by the Pharmacies; each Pharmacy is solely responsible for its professional services. Peak Revival Plus is not a healthcare provider, and using the Service does not create a provider-patient relationship with Peak Revival Plus. You may, however, establish a provider-patient relationship with the Medical Group and/or one or more Providers.
By accepting this Agreement, you consent to receiving communications via audio, visual, audiovisual, messaging services, or email from the Medical Group and/or the Providers through the Service related to your diagnosis and/or treatment. Peak Revival Plus is not responsible for the security or privacy of the communication services you use to receive such communications. You are solely responsible for monitoring and responding to communications; neither Peak Revival Plus, the Medical Group, nor any Provider is liable for any loss, injury, or claims arising from your failure to read or respond, or to follow treatment recommendations or instructions.
Although you are not establishing a provider-patient relationship with Peak Revival Plus, by using the Service you enter into a direct customer relationship with Peak Revival Plus for use of the Service, including purchasing any non-prescription products or non-medical services sold directly to you. In this relationship, you may provide personal information—including health information—subject to our Privacy Policy. See the “Privacy Policy” and “Protected Information” sections below.
Consent to Use Telehealth Services
The Service involves telehealth—the provision of health and mental health services through electronic communication when you and the Provider are not in the same location. Telehealth has benefits and risks and may not be appropriate in all situations. To use the Service, you must review and agree to a Telehealth Consent, provided via the Service. By agreeing, you acknowledge Peak Revival Plus, the Pharmacies, the Medical Group, and the Providers are third-party beneficiaries of the Telehealth Consent and may enforce it against you.
Subscription Products and Services
Some products and services are offered on an automatically renewing subscription basis. Your payment method will be charged automatically at regular intervals as described at checkout until you cancel. To prevent treatment interruptions, your first renewal may be charged early. Subsequent shipments may be charged and shipped up to three (3) days early to account for holidays or operational needs. We and/or Providers may contact you to request information updates and help manage subscriptions. You may cancel anytime via your online account or by emailing info@peakrevivalplus.com Cancellation takes effect at the end of the current subscription period. Subscriptions renew unless you cancel at least three (3) days before the renewal processing date. We do not offer refunds for partially used periods, though we may issue refunds case-by-case at our sole discretion. We may allow you to pause your subscription; if you do not cancel before the pause ends, billing resumes. Plans and prices may change; we will provide advance notice of material changes.
For subscription products requiring a Provider consultation, prescription medication from a Pharmacy, and/or health services, the “total” subscription price you see includes: (i) fees for use of the Service; (ii) medication costs charged by the Pharmacy; and (iii) Provider service fees charged by the Medical Group, as applicable. We collect these amounts on behalf of, and remit them to, the Pharmacies and Medical Group, respectively.
NO REFUND POLICY
YOU ACKNOWLEDGE AND AGREE THAT, DUE TO THE NATURE OF THE PRODUCTS AND SERVICES AVAILABLE THROUGH THE SERVICE, ANY FEES AND OTHER CHARGES ARE NOT REFUNDABLE IN WHOLE OR IN PART. YOU ARE FULLY LIABLE FOR ALL CHARGES TO YOUR ACCOUNT, INCLUDING ANY UNAUTHORIZED CHARGES.
Prescription Products
Certain products require a valid prescription from a licensed Provider. You may obtain a prescription product only after completing a consultation with a Provider who determines the product is clinically appropriate and issues a valid prescription. Providers are solely responsible for those clinical determinations.
If a Provider issues a prescription and you consent to the product, the Provider will submit the prescription to a Pharmacy. Unless you request a specific pharmacy during your consultation and that pharmacy can fulfill the prescription, prescriptions will be filled by a Pharmacy with which Peak Revival Plus has a relationship, selected based on factors such as location and availability. Prescriptions filled by the Pharmacies may not use child-resistant packaging or containers. You are responsible for storing products safely and away from children and others.
If you fill through one of the Pharmacies, the Pharmacy ships the product to you, and the related costs are included in the total charged to you as described in “Subscription Products.” If you choose another pharmacy, we will send the prescription there; you must obtain and pay that pharmacy directly.
Prescription products available through the Website are “Third-Party Goods and Services” (see below).
Financial Responsibility for Services Notice
Peak Revival Plus and the Medical Group are not enrolled in, and do not participate as providers in, any federal or state healthcare programs (e.g., Medicare, Medicaid) for the provision of healthcare services or supplies via the Service. To the extent any Pharmacy or Provider may be enrolled in such programs, the method by which services and products are offered through the Service generally prevents them from being covered benefits. By choosing to use the Service, you are opting to obtain all services and items on a self-pay basis, outside any federal or state healthcare program. You are solely responsible for all costs.
By using the Service, you acknowledge and agree that: (1) you are explicitly choosing self-pay, outside any federal or state healthcare program, and you are solely financially responsible for all services and items provided through the Service; and (2) neither you nor Peak Revival Plus, the Medical Group, Providers, or Pharmacies will submit any claims for reimbursement to any federal or state healthcare program for costs of services or items provided through the Service.
Restrictions on Use and Availability of the Service
The Service is available only to individuals located in states where we offer the Service, who are at least eighteen (18) years old (or the age of majority in their jurisdiction, if higher), and who have accepted this Agreement; however, individuals ages 13 to 18 in states where we offer the Service may use it with a parent or legal guardian’s consent as set out in this Agreement and the Service. Current states in which we do not offer Service: Alaska, Arkansas, Louisiana, New Hampshire, Oregon, South Carolina, West Virginia, and the District of Columbia.
By visiting, accessing, registering for, or using the Service, you: (a) represent and warrant you are either (1) at least 18 (or the age of majority in your jurisdiction, if higher) or (2) at least 13 and have parental/guardian consent; (b) if providing consent for a minor, represent you are the parent/guardian with authority to consent; (c ) represent that when you consult with a Provider, you are located in the same state as the shipping address in your account at the time of the consultation; (d) agree to comply with all applicable laws; and (e) agree to use the Service only for lawful purposes. The Service is subject to state regulations and may change as regulatory requirements change. Certain products are subject to additional age restrictions and may not be available to all age groups.
In some cases, the Service may not be the appropriate channel for your care. Your condition may require in-person evaluation or procedures, or a Provider may determine your diagnosis/treatment requires an in-person visit or is otherwise not suitable for telehealth. In such cases, you may be notified that you cannot use the Service for that issue and may receive guidance on next steps.
Duty to Provide Information, Access, and Connectivity
You are responsible for obtaining and maintaining, at your own expense, the hardware and software needed to access and use the Service (e.g., a device with a camera and Internet access) and for any fees you incur (e.g., data charges). You must provide truthful, accurate, and complete information in forms or communications you submit through the Service. We may modify access configurations, including software, hardware, or other requirements, at any time without prior notice.
Privacy Policy
Peak Revival Plus understands the importance of confidentiality and privacy. Please see our Privacy Policy for how we collect, use, and disclose your personal information.
Protected Health Information
When you create an account, you establish a direct customer relationship with Peak Revival Plus, enabling you to use the Service. You provide information such as your name, email, shipping address, and phone number, which we may collect, use, and disclose under our Privacy Policy. This information is not “health” or “medical” information.
When using certain parts of the Service, you may also provide medical information protected by law. Peak Revival Plus is not a “covered entity” under the Health Insurance Portability and Accountability Act of 1996 and its regulations (“HIPAA”). The Medical Group or Pharmacies may be covered entities or business associates under HIPAA; Peak Revival Plus may, in some contexts, be a business associate. HIPAA does not apply simply because health information is involved, and HIPAA may not apply to your transactions or communications with Peak Revival Plus, the Medical Group, Providers, or Pharmacies. To the extent Peak Revival Plus is a business associate, and solely in that role, Peak Revival Plus may be subject to certain HIPAA provisions regarding “protected health information” (“PHI”) you provide to the Medical Group, Providers, or Pharmacies. Medical/health information specifically protected under applicable state laws, together with PHI (“Protected Information”), will be used and disclosed only as permitted by such laws. Information not constituting Protected Information may be used or disclosed as permitted by our Privacy Policy. Protected Information does not include information de-identified under HIPAA.
The Medical Group and Providers adopt a Notice of Privacy Practices describing how they use and disclose Protected Information. By accessing or using any part of the Service, you acknowledge receipt of the Notice of Privacy Practices from the Medical Group and Provider(s).
By using the Service, you agree that—even if HIPAA applies to any party—information you submit to Peak Revival Plus that is not intended and used solely for diagnosis/treatment by the Medical Group/Providers or for prescription fulfillment by the Pharmacies is not Protected Information and is subject to our Privacy Policy and applicable state laws.
Use and Ownership of the Service
The Service and Content are protected by copyright and other laws. Subject to this Agreement, Peak Revival Plus grants you a limited, non-transferable, revocable license to access and use the Service for your personal use solely for its intended purposes. Unless we grant a separate license, your right to use the Service and Content is governed by this Agreement, and all rights are reserved by Peak Revival Plus. Peak Revival Plus and its suppliers own all rights, title, and interest in the Service (including code, themes, concepts, text, images, product descriptions, posts, artwork, audiovisual effects, methods, moral rights, and documentation). Do not remove, alter, or obscure any proprietary notices. “Peak Revival Plus” and related graphics, logos, service marks, and trade names used with the Service are trademarks of Peak Revival Plus and may not be used without permission. Other marks are the property of their owners.
License to Information You Submit
Except as limited by law or these Terms, any information you send to Peak Revival Plus via the Service (e.g., data, questions, comments, forum posts, suggestions) (“Submissions”) will, to the extent permitted by law, be treated as non-confidential and non-proprietary. Subject to your applicable account settings, you grant Peak Revival Plus a fully paid, royalty-free, perpetual, irrevocable, worldwide, non-exclusive, sublicensable license (including moral rights) to use, license, distribute, reproduce, modify, adapt, publicly perform, and publicly display Submissions (in whole or part) to operate and provide the Service to you and other Users. You warrant that holders of any IP rights in Submissions have waived such rights or granted you the right to grant this license. You are solely responsible for your Submissions. We may edit, duplicate, or alter Submissions for any purpose we deem necessary or desirable. You irrevocably waive any moral rights in Submissions and acknowledge you have no right of approval or claim to compensation. If a Submission contains Protected Information, our rights are limited as required by applicable law.
Prohibited Use
You may not use or attempt to use the Service: (i) for any unlawful, unauthorized, fraudulent, or malicious purpose; (ii) to damage, disable, overburden, or impair any server or network; (iii) to interfere with others’ use of the Service; (iv) to gain unauthorized access to accounts, systems, or networks; (v) to access systems, data, or information not intended for you; (vi) to obtain materials or information not intentionally made available; (vii) to reverse engineer, disassemble, or decompile any part of the Service; or (viii) for any purpose other than the Service’s intended business use.
You also agree not to: upload/transmit unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or discriminatory content; create a false identity or impersonate others; upload content you lack rights to; upload malware or malicious code; delete author attributions or legal notices; misuse communication features (e.g., excessive caps/flooding); send unsolicited promotions/spam/chain letters/phishing; violate any law; infringe others’ IP rights; delete or revise others’ material; frame/mirror the Service; probe/scan/test vulnerabilities or breach authentication; register/subscribe/unsubscribe others without authorization; harvest others’ information; use robots/spiders/scrapers or other automated/manual means to access, copy, download, distribute, or reproduce Service content; or assist others to do any of the above.
We may take lawful actions we deem appropriate for violations, including suspending or terminating access/accounts. We may cooperate with authorities or third parties in investigations. Except as provided in the Privacy Policy or prohibited by law, we reserve the right to disclose information as necessary to satisfy laws, regulations, legal processes, or governmental requests, or to edit/refuse/remove materials in our sole discretion.
Registration; User Accounts, Passwords, and Security
You may need to register and create an account to access certain features. Information you provide for account setup (e.g., name, username, email, shipping address, phone) is not Protected Information under the “Protected Health Information” section. You agree to keep your information accurate and up to date. If you do not, or we suspect inaccuracies, we may suspend or terminate your account and use of the Service. Notify us immediately of any unauthorized use of your credentials or other security breach. Keep your username/password confidential and log out at the end of each session. We disclaim liability for losses arising from your failure to comply. You may not use another person’s account.
We take steps to protect user data, but the Service runs on software, hardware, and networks that may require maintenance or experience issues or security breaches beyond our control. Others with access to your devices may access the Service and your information (including medical information). Log out when not in use and secure your devices and credentials. You must exercise caution and good judgment. Security violations may result in civil and/or criminal penalties; we may investigate and cooperate with law enforcement.
Third-Party Goods and Services; Indemnification
Parties other than Peak Revival Plus—including Pharmacies, the Medical Group, and Providers—may provide services or sell products through the Service (collectively, “Third Parties”), and Peak Revival Plus may make available services, devices, items, or products manufactured, distributed, or sold by Third Parties (“Third-Party Goods and Services”). Your use of Third-Party Goods and Services and interactions with Third Parties (including payment, delivery, and related terms, conditions, warranties, and representations) are solely between you and those Third Parties. Investigate as you deem appropriate before any transaction. You are solely responsible for using the Service and disclosing personal information with caution.
Peak Revival Plus is not responsible or liable for any loss or damage arising from your use of the Service, Third-Party Goods and Services, or interactions with Third Parties. In any dispute between you and any Third Party, other user, entity, or individual, Peak Revival Plus has no obligation to become involved. You release and indemnify Peak Revival Plus and its parents, subsidiaries, affiliates, and their respective contractors, directors, officers, employees, representatives, partners, shareholders, agents, predecessors, successors, assigns, and attorneys (collectively, the “Peak Revival Plus Parties”) from all claims, demands, and damages of every kind, known or unknown, arising out of or related to such disputes or the Service. You agree to defend, indemnify, and hold Peak Revival Plus and any Third Parties offering products or services through the Service—including the Medical Group, Providers, and Pharmacies—harmless from and against any and all claims, damages, liabilities, losses, costs, and expenses (including attorneys’ fees) arising from your use of the Service, your fraud, violation of law, willful misconduct, breach of this Agreement, or violation of others’ rights. We may control the defense of any third-party claim for which we are entitled to indemnification; you will cooperate as reasonably requested.
IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE § 1542, WHICH STATES: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”
Right to Monitor
We may monitor general use of the Service at any time and remove materials that, in our sole discretion, may be illegal, may subject us to liability, may violate this Agreement, or are inconsistent with the Service’s purpose.
Terms of Sale
All products offered for sale by Peak Revival Plus are subject to availability. We may impose quantity limits or reject all or part of an order without prior notice. In the event of an error, we may correct the error and revise your order (including charging the correct price) or cancel and refund any amount charged. Prices may change at any time. You are responsible for any applicable sales, use, duty, customs, or other governmental taxes, levies, or fees (“Taxes”) due with respect to your purchases through the Service. We will collect applicable Taxes if required to do so.
